Dispute Resolution Process

This Dispute Resolution Process outlines how we handle any claims or disputes related to your purchase of products or services from us, your interactions with our store, and your use of our website. By using our services, you agree to resolve disputes through arbitration. Here’s how it works:
Scope of Arbitration
Any claims arising from your interactions with us, including product purchases, services, or website usage, will be resolved through binding arbitration rather than in court. However, if a claim falls within the jurisdiction of a small claims court, you or we may opt to resolve the dispute there. Federal arbitration laws will govern this process.
Informal Resolution
We believe in resolving disputes quickly and efficiently through informal methods. Before initiating arbitration, you must submit a Notice of Dispute to our Legal Department. This notice should include all relevant information about the claim. Upon receiving the notice, both parties will have 60 days to attempt to resolve the matter informally, which may include a phone or video conference.
Arbitration Forum and Fees
If informal resolution fails, either party may begin the arbitration process by submitting a written request. The arbitration will be conducted by the American Arbitration Association (AAA) under its consumer dispute rules. Fees associated with arbitration will follow AAA guidelines, and if necessary, we will cover the costs if you’re unable to pay.
Arbitration can be held via phone, video conference, or in person, depending on your preference.
Waiver of Jury Trial and Class Actions
By agreeing to arbitration, both parties waive the right to a jury trial. Additionally, disputes will be resolved individually and not as part of a class action or other collective proceedings. No class actions or consolidated claims are permitted.
Batch Arbitration
If multiple customers have similar claims, a batch arbitration process may apply. Claims will be grouped in batches of no more than 20 cases, which will be resolved individually. Additional claims will follow in subsequent batches.
Arbitrator’s Powers and Duties
The arbitrator will apply the law to resolve the dispute and can award the same remedies as a court. However, punitive damages are not allowed. Arbitration decisions are binding, and court review is limited.
Small Claims Court
If a claim qualifies for small claims court, either party may choose to take it there instead of arbitration. This can be done at the start of the claim or during the arbitration process, subject to certain conditions.
Severability
If any part of the arbitration agreement is found to be unenforceable, it will be removed, but the rest of the agreement will still apply. However, if the prohibition on class actions is deemed invalid, the entire arbitration agreement will be void.
Governing Law
All disputes will be governed by the laws of the State of Arizona.
Waivers and Limitations
All claims must be brought within one year of their occurrence, or they will be barred permanently.
